Terms of Service

Welcome to Plus+. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Ann Hess, operating as Plus+ as a sole proprietorship under Swiss law ("Plus+," "we," "us," or "our"). By accessing or using the Plus+ mobile application ("App") or any related services (collectively, the "Service"), you agree to be bound by these Terms.

Please read these Terms carefully before using the Service. If you do not agree with any part of these Terms, you must not use the Service.

1. Acceptance of Terms

By creating an account, downloading the App, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We reserve the right to update or modify these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

2. Description of Service

Plus+ is a sexual health intelligence and wellness application designed to help users track, understand, and improve their sexual health and overall well-being. The Service may include features such as health tracking, pattern analysis, an AI-powered wellness coach ("AI Coach"), and integration with third-party health platforms.

Plus+ is a wellness and informational tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. The Service is intended for general health awareness and educational purposes only.

3. Medical Disclaimer

IMPORTANT: Please read this section carefully.

The information provided through the Service, including but not limited to content generated by the AI Coach feature, is for general informational and educational purposes only. Plus+ does not diagnose, treat, cure, or prevent any disease or medical condition.

The AI Coach is an automated tool that provides general wellness guidance and informational content. It is not a substitute for professional medical advice, diagnosis, or treatment. The AI Coach does not function as a healthcare provider, therapist, counselor, or medical professional of any kind.

You should:

  • Always consult a qualified healthcare professional before making any decisions related to your health, including sexual health.
  • Never disregard professional medical advice or delay seeking it because of information provided by the Service.
  • Seek immediate medical attention if you believe you have a medical emergency.
  • Not rely on the Service for any form of clinical diagnosis or treatment plan.

Plus+ makes no representations or warranties regarding the accuracy, completeness, or applicability of any health-related information provided through the Service. Use of the Service is entirely at your own risk.

4. Eligibility

The Service is intended for individuals who are at least 18 years of age. By creating an account or using the Service, you represent and warrant that you are at least 18 years old. Given the nature of the sexual health content provided through the Service, we do not knowingly permit use by individuals under 18.

If we become aware that a user is under 18, we will terminate their account and delete their data in accordance with applicable law.

5. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate and complete.
  • Maintain the security and confidentiality of your login credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately at hello@plushealth.app if you suspect any unauthorized use of your account.

You are solely responsible for any activity conducted through your account, whether or not you authorized that activity. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

6. Subscription and Billing

6.1 Free Tier

Plus+ offers a free tier with limited access to features. No payment is required to use the free tier. The free tier includes contextual advertisements. You can remove ads by upgrading to Plus+ Pro.

6.2 Pro Subscription

Plus+ Pro is available as a monthly subscription at $9.99 per month (USD). The Pro subscription includes a 7-day free trial for new subscribers. After the trial period ends, you will be automatically billed at the monthly rate unless you cancel before the trial expires.

6.3 Billing and Auto-Renewal

Pro subscriptions are billed on a monthly recurring basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. Payment is processed through the Apple App Store or Google Play Store, depending on your device platform.

6.4 Cancellation

You may cancel your Pro subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period. You will retain access to Pro features until the end of the period you have already paid for.

6.5 Refunds

No partial refunds are provided for the current billing period upon cancellation. Refund requests for charges processed through the Apple App Store or Google Play Store are subject to the respective store's refund policies. We do not have the ability to issue refunds for purchases made through third-party app stores.

6.6 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will apply to the next billing cycle following notice.

6.7 Advertising

The free tier of Plus+ displays contextual, non-personalised advertisements. These ads are not based on your health data. You can remove all advertisements by upgrading to Plus+ Pro.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Share, sell, or transfer your account credentials to any other person.
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Use automated scripts, bots, or other means to access the Service.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Upload, transmit, or distribute any viruses, malware, or other harmful code.
  • Use the Service to harass, abuse, or harm another person.
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission.

Violation of these rules may result in immediate termination of your account.

8. Intellectual Property

8.1 Our Property

The Service, including the App, its design, features, functionality, code, content, graphics, logos, and trademarks, is owned by Plus+ and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

8.2 Your Data

You retain ownership of all data, content, logs, and notes you create or input through the Service ("User Content"). By using the Service, you grant Plus+ a limited, non-exclusive license to process and store your User Content solely for the purpose of providing and improving the Service. We do not claim ownership of your User Content.

9. User Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

We are committed to compliance with the General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (nDSG). You may exercise your data rights as described in our Privacy Policy or by contacting us at hello@plushealth.app.

10. Third-Party Integrations

The Service may offer integrations with third-party platforms and services, including but not limited to Apple Health, Oura, Whoop, Fitbit, and Google Health Connect. These integrations are provided for your convenience and are subject to the following conditions:

  • Third-party services are governed by their own terms of service and privacy policies.
  • Plus+ is not responsible for the availability, accuracy, or reliability of third-party services.
  • We are not liable for any loss, damage, or inconvenience caused by your use of or reliance on third-party services.
  • You are responsible for reviewing and accepting the terms and policies of any third-party service you connect to the App.

Integration with third-party services does not imply endorsement by Plus+.

11. Disclaimers and Limitation of Liability

11.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, PLUS+ DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Plus+ does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. Plus+ makes no warranty regarding any health outcomes, wellness improvements, or results from using the Service.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLUS+, ITS OPERATOR, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN ANY CASE, THE TOTAL AGGREGATE LIABILITY OF PLUS+ ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO PLUS+ IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT MADE ANY PAYMENTS, OUR LIABILITY SHALL NOT EXCEED TEN SWISS FRANCS (CHF 10.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless Plus+, its operator Ann Hess, and any agents, contractors, or service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of or access to the Service.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Your violation of any third-party right, including intellectual property or privacy rights.
  • Any User Content you submit or transmit through the Service.

13. Termination

13.1 Termination by You

You may delete your account at any time through the App settings or by contacting us at hello@plushealth.app. Upon deletion, your User Content will be removed in accordance with our Privacy Policy.

13.2 Termination by Us

We reserve the right to suspend or terminate your account, without prior notice or liability, if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service, other users, or Plus+. We may also terminate or suspend accounts for extended periods of inactivity.

13.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 3, 8, 11, 12, and 14.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of Switzerland, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts at the domicile of the operator in Switzerland.

Before initiating any formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at hello@plushealth.app. We will attempt to resolve the dispute in good faith within thirty (30) days.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by posting the updated Terms within the App or on our website at plushealth.app, and by updating the "Effective Date" at the top of this page.

Your continued use of the Service after any changes to the Terms constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service and delete your account.
